  • Government road defects (Gov. Code § 835) potholes, absent guardrails, and defective road design impose liability on the responsible public entity, subject to an accelerated 6-month notice deadline.

Where a defendant violated a statute enacted to protect motorcyclists such as CVC §§ 22107, 21801, or 23153 the violation constitutes negligence per se under CACI No. 418. The factfinder does not re-evaluate reasonableness; the statute already made that determination.
